What is tortfeasor?

Let’s start with: what is a tort? A tort is a wrongful act or an action that harms someone else, and it’s usually a civil (non-criminal) offense.

A tortfeasor is a legal term for someone who has committed a tort. The tortfeasor is someone who has done something wrong that has caused harm to another person, and they can be held legally responsible for their actions in a civil court.

What are the potential consequences for a guilty tortfeasor?

  • Pain and suffering
  • Loss of earnings

For example, a social media influencer uses a copyrighted image to promote their own product. The image owner could sue them for using a copyrighted image in their advertising campaign without permission. If found guilty as a tortfeasor, the influencer would have to pay monetary damages and may lose their right to sell on that social media platform. Other consequences may include criminal penalties and jail time.
